Frequently Asked Questions

Below is a selection of frequently asked questions from professionals seeking to instruct a barrister for their clients. We will be adding more as we get them so please check back from time to time, or you can email us if your specific question is not answered here.

We would also recommend reading more general FAQ.

Do you provide legal advice and representation in the following area of law?

Legal advice and representation is available in these areas of law. If you are in any doubt as to whether the issue raised in your case would be covered, get in touch with us and we will be happy to help.

Are you fully insured?

Yes. We are fully insured in accordance with the requirements for all practising barristers.

How long does it take to provide Counsel's opinion?

This will depend on a number of factors, such as whether it is necessary to conduct a face-to-face consultation, whether further documents are required from the client and the complexity of the legal issue itself. In general, we hope to have Opinions with you within two weeks of being instructed in the matter.

Do you provide representation in all courts?

Most of Mahmud's work is carried out in the High Court, Court of Appeal and Supreme Court. This is largely because the nature of the work itself can only be conducted in those courts. But representation may also be provided in the Circuit Court.

Does Mahmud practice in every circuit?

No, most barristers in Ireland will practice in one or two circuits but rarely more than that. If Mahmud is unable to attend court in your circuit then we will do our best to recommend a different barrister who practices in that circuit and who will be able to assist you.

What about mediation and arbitration?

Mahmud is an accredited mediator and represents parties in both mediation and arbitrations in his specialist practice areas.

What kind of fees can my client expect to pay?

The amount of fees are determined by the complexity of the work involved in your legal query. We will always provide you with a quote before your client commits to paying a penny.

I would like to instruct Mahmud in a number of cases. Will this result in any discount in fees?

Numerous briefs from the same solicitor or accountant may result in discounted fees. This will depend on the specific circumstances, so please contact us for further information.

Can you recommend an alternative solicitor for my client as I am unavailable?

We understand that solicitors cannot always accept work, for example where they do not practice in the area of law in question. We may be able to assist using our extensive knowledge of Irish law firms and links with them. You can ask your client to contact us and we will do our best to recommend an alternative solicitor.

Do you charge a fee for recommending a solicitor?

No. This is a complimentary service, and we will make recommendations only where we are aware of law firms which can assist your client. We do not receive any payment or other advantage from the firms in question.

I am an accountant. What services are available to me?

Members of certain bodies, including most accountancy bodies, may directly instruct barristers without going through a solicitor. This may include requests for legal opinion, but not court representation or representation before other tribunals (such as disciplinary bodies), which will always require a solicitor. Feel free to contact us if you or your client require legal advice relating to any of our practice areas - you do not need to go through a solicitor. Most of Mahmud's direct instructions from accountants relate to receiverships, examinerships and liquidations, but other queries are also welcome.

If you require representation but you do not have a solicitor, feel free to contact us and we will be happy to recommend a firm of solicitors appropriate to your query.
