Breach of contract

Contracts are the lifeblood of commerce. They set out the nature of your relationship with customers, suppliers, partners, landlords, advisors and a myriad of other parties. A failure by you or they to comply with the duties and obligations set out in the contract can often raise complex legal issues, often requiring litigation. We aim to help you resolve your contractual disputes as quickly and cost-effectively as possible. For example, we may recommend mediation to help restore your relationship with the other party or, where that is not possible, advise on your prospects of success should the matter proceed to court. In general, the basic concepts of contract law are the same irrespective of the kind of contract and we can therefore help with any contractual dispute, whether it is the provision of faulty goods by a supplier, failure to pay for services by a customer, breach of the terms of a commercial lease etc.

Below are just some of the matters in relation to which we have advised clients in contractual disputes:

  1. Issuing legal proceedings on behalf of a landlord to recover arrears of rent under a commercial lease.
  2. Advising about the proper jurisdiction in which to issue legal proceedings in respect of a contract signed in England by a client living in Ireland.
  3. Advising on the options available to a client for recovering damages for breach of a commercial agreement.
  4. Defending a client accused of breaching the terms of a commercial sales contract.
  5. Issuing proceedings for the specific performance of a license agreement.
  6. Representing clients in mediation for the compromise of their duties under a commercial contract.
  7. Representing employees who had obtained decisions in their favour from an employment tribunal on the best way of enforcing them against their former employer.
